The state’s highest court is expressing concern about a new oversight commission with the powers to sanction or even oust prosecutors. The AJC reports the Georgia Supreme Court Friday asked the state’s attorneys to answer a key constitutional question …about whether the court has the legal authority to approve rules setting up the commission as required by the state law. The court’s order could at least temporarily stop the commission from taking action on complaints against prosectors… at least until legislators reconsider the legislation. The commission was created at the urging of Governor Kemp who sought a way to reprimand rogue prosecutors. Several DA’s have raised issues over the law creating the commission saying it improperly blurs the line between the three branches of government.
