Georgia High Court Won't Stop Vote on Creation of New City

Georgia's highest court has declined to stop a vote on whether a new city should be created from part of the existing city of Stockbridge.

The referendum on the ballot for November's midterm elections would create the city of Eagle's Landing from a part of Stockbridge combined with unincorporated parts of Henry County. The Georgia Supreme Court last week heard arguments in an appeal of a lower court ruling allowing the referendum to proceed.

Lawyers for Stockbridge argue that the underlying legislation violates the state Constitution. Lawyers for Eagle's Landing supporters argue that lawmakers acted within their authority.

The high court on Monday denied a request by Stockbridge to expedite the appeal or halt voting on the referendum. It did not rule on the merits of the case.
