Georgia High Court Upholds Canceling of Judicial Election

The Georgia Supreme Court has ruled that Secretary of State Brad Raffensperger cannot be forced to hold an election that was scheduled this year for a seat on the high court. That seat will become vacant with the resignation of Justice Keith Blackwell in November.

In a 6-2 decision, the state Supreme Court said Thursday that Blackwell’s decision to resign was irrevocable once accepted by Gov. Brian Kemp. The majority opinion said that under Georgia’s Constitution, such vacancies on the state’s high court are filled by the governor, not by voters in an election.
