There’s an update in the Athens-Clarke County Police Department’s downtown investigation involving a University of Georgia student. According to a release from the department, the ACCPD has concluded that there is no evidence to support that a rape occurred.
Financial transaction card-related charges have been filed against Timothy Evans. A second individual, Dennie Smith of Athens, has been charged with similar crimes including financial transaction card theft and financial transaction card fraud.
The release states the ACCPD takes all reports of sexual assault seriously and appreciates the cooperation of those involved throughout the investigation.

On August 21, police responded to a local hospital regarding a possible sexual assault that happened near City Hall in downtown Athens.
According to a police report, a 20-year-old University of Georgia student last remembered drinking with friends in downtown Athens around midnight last Thursday. She told police she woke up early Friday on cardboard boxes near a homeless man who was touching himself.
The police report said the UGA student could not find her phone or purse. She told police that she was escorted home by “two kind older homeless men” before sunrise.
According to the report, she contacted police and described the location where the instance occurred. The police concluded that the location was near City Hall, the police report said.
